WILLS, TRUSTS AND PROBATE

Protecting those you care about

Wills

Making a will probably isn't something you like to think about. But it is the only way to ensure everything you've worked hard for goes where you want it to. It is the only way to protect the people you care about.

If you die without a will, the law decides who inherits your estate and in what proportion (known as the "Intestacy Rules"). These rules do not cover unmarried partners, life-long friends, your favourite charities or step-children. Relatives you have lost touch with may inherit under these rules, instead of those closest to you.

We offer a sensitive and professional will-making service. Unlike other providers, your will is written by one of our qualified solicitors. They understand the precise nature of how your will should be worded, giving you peace of mind that your wishes will not be misunderstood or challenged.

We discuss your personal situation carefully with you at a face-to-face meeting. We give practical advice and prompt you about things you may not have considered. Issues such as who to appoint as executors, and naming guardians for your children if you die before they reach 18.

Our standard charge for preparing and storing your will is £95 +VAT or £145 +VAT for a couple making similar wills.

Call Caroline French or Melanie Brown on 01384 255344 to discuss making your will.

Trusts

Trusts can be set up either during your lifetime or through your will to overcome taxation or personal issues. For example, you may not wish your children or grandchildren to inherit at a young age. In this case a trust can be created with trustees who look after the assets for the beneficiaries, either for life or until they reach a certain age.

You may wish to provide for someone during his or her lifetime but maintain control over the destiny of the trust capital. Or if you have surplus cash or assets you can create a tax efficient trust to reduce the impact of inheritance tax on your estate.

This is a complex and constantly changing area of law. Our specialists give clear, up-to-date, professional advice on how to plan ahead for your future and that of your beneficiaries.

Probate - help for executors/personal representatives

If you lose someone close to you or are appointed the executor of a will, we can help with the responsibility of administering the estate.

Being a Personal Representative is a heavy burden. It can be time-consuming and legally complex. For example, you have a responsibility to report to the Inland Revenue and the Probate Registry. You may also have to resolve disputes between family members.

We help you with the task of getting probate, deal with the assets of the estate and ensure that the wishes of the deceased are carried out. Often, we can help you finalise matters more quickly than you could on your own.
